According to the ruling, by speaking in Catalan (which is the father's mother tongue) to his own daughter, the father was damaging the emotional bonds with her mother, who is Spanish.
The couple divorced in April 2010, and the custody of the daughter was given to the father by the court. Later on, the mother moved to Santander (northern Spain), and then she decided to appeal the ruling alleging the dad was being abusive to her daughter by only speaking to her in Catalan. The judge recognized that both, father and mother, are fully capable of taking care of their daughter. However, she decided to take away the custody from the father just on linguistic grounds.
