International Trial Watch: "the Spanish judgment is unfair and violates rights”

The International Trial Watch Conference about the assessment of the Spanish Supreme Court's judgement against Catalan social leaders and politicians announced the report issued by 31 organisations and 533 legal professionals from 23 countries.

On behalf of the ITW it was explained that the judgment has consequences on the fundamental rights of all citizens. And it is very important the amount of support received after a broad and detailed observation process. “I cannot understand how the exercise of demonstration can be charged with sedition and imprisonment between 9 and 13 years. Clearly this judgment is unfair and violates rights” Mireille Jordan, lawyer from Belgium and AED.
“Art. 9 ECHR on freedom of thought includes the right to peaceful assembly. The judgement is a violation of this right as it condemns peaceful demonstrations with prison”. "We were always certain we had to take part in the national and international observation process of the trial. The judgement violates fundamental rights that affect all citizens", said Belen de Las Nieve.

“One of the main violations, both formal and material, was carried out during the evidence. The right to contradict during cross examination was in practice denied”. “The facts had no effect outside of Catalonia, so they should have been tried in Catalonia. By judging them in the Supreme Court, the right to a double instance was denied. This affects the right to a fair trial. The use of sedition does not take into account the exercise of fundamental rights such as freedom of expression, assembly and freedom of ideology. By criminally condemning peaceful protests, a fundamental right is being criminalised.”
